Gamescrate (“Gamescrate.app”, “we”, “our”, “us”) is owned and operated by Cronweb Solutions Private Limited.

These Terms of Use govern your access to and use of GamesCrate.app, including our gaming portal, accounts, developer services, publisher services, game embeds, APIs and related functionality.

By accessing or using GamesCrate, you agree to these Terms.

If you do not agree, do not use the service.

1. GamesCrate

GamesCrate is an online gaming platform that may provide:

• Browser-based games
• Game discovery
• Player features
• Developer submission tools
• Publisher integrations
• Game embeds
• Publisher API access
• Advertising-supported content
• Partner reporting
• Revenue-sharing opportunities
• Other gaming-related services

Features may change over time.

2. Eligibility

You must be legally permitted to use GamesCrate under the laws applicable to you.

If you are below the age required to enter into these Terms in your jurisdiction, your parent or legal guardian must supervise or approve your use where required.

Developer, publisher and other business-account users must have legal authority to enter agreements on behalf of themselves or the organization they represent.

3. Free Access

Many GamesCrate games are available without payment from the player.

Free access does not mean that all content is owned by GamesCrate or that every feature will always remain available.

Games and services may be supported through advertising, partnerships or other commercial arrangements.

4. Accounts

Some features require an account.

You are responsible for:

• Providing accurate information
• Maintaining control of your account
• Protecting your credentials
• Keeping your email address current
• Not sharing private API tokens
• Informing us if you believe your account has been compromised

You may not create accounts using false identities for fraudulent, abusive or deceptive purposes.

5. Player Accounts

Public player accounts may use supported social-login providers.

Account features can include favorites, profiles, game history or similar functionality.

GamesCrate may restrict, suspend or disable an account when reasonably necessary for:

• Security
• Fraud prevention
• Abuse
• Violation of these Terms
• Legal requirements
• Platform integrity

6. Developer Accounts

Approved developers may submit games for review.

Submission does not guarantee approval, publication, compensation or continued availability.

GamesCrate may reject or remove a submitted game for reasons including:

• Poor quality
• Technical problems
• Security risks
• Copyright concerns
• Prohibited content
• Misleading information
• Broken gameplay
• Incompatible advertising
• Policy violations
• Business or catalog decisions

7. Rights in Developer Submissions

You must own or have sufficient rights to submit every game, image, description, trademark, asset and other material you provide.

By submitting content for publication, you grant GamesCrate a non-exclusive, worldwide license, for as long as the content remains approved or as otherwise reasonably necessary, to:

• Host
• Reproduce
• Display
• Distribute
• Embed
• Promote
• Create technical copies
• Resize or optimize assets
• Make the game available through GamesCrate
• Make eligible games available through approved publisher integrations

This license is solely for operating, distributing and promoting the submitted game and related GamesCrate services.

You remain responsible for ensuring that your submission does not infringe third-party rights.

8. Developer Rewards

GamesCrate may offer eligible developers fixed rewards, promotional rewards or other compensation for approved submissions.

Any such program:

• May be enabled or disabled
• May use different rates
• May require approval
• May be subject to additional conditions
• Does not guarantee that every submission will earn money

An amount shown before final approval does not create an unconditional payment obligation where fraud, duplicate submissions, ownership problems or policy violations are discovered.

9. Publisher Accounts

Approved publishers may use GamesCrate distribution tools to make eligible games available through approved properties.

Publisher functionality may include:

• Direct publisher links
• Game embeds
• API access
• Catalog access
• Properties
• Reporting
• Revenue-sharing opportunities
• Withdrawals

Publisher access is a privilege subject to approval and continued compliance.

10. Publisher Properties

Publishers must provide accurate information about websites, applications or other properties submitted for approval.

You may not knowingly use GamesCrate integrations on an unapproved, deceptive, illegal or materially different property.

GamesCrate may require an edited property to be reviewed again.

Approval does not represent endorsement of a publisher or guarantee earnings.

11. Publisher Integrations

Publishers must use integrations only as documented or authorized.

You must not:

• Remove required attribution
• Misrepresent GamesCrate content as your own
• Circumvent tracking
• Share private API credentials publicly
• Scrape protected APIs
• Modify integrations to create false payable activity
• Automatically generate artificial plays
• Use bots or click farms
• Incentivize fraudulent activity
• Manipulate reporting

GamesCrate may invalidate activity reasonably identified as duplicate, fraudulent, automated, manipulated or otherwise ineligible.

12. Publisher API

Publisher API credentials are confidential.

You are responsible for protecting your token.

GamesCrate may:

• Rate-limit API access
• Revoke compromised credentials
• Require token regeneration
• Change API fields
• Disable abusive integrations

Publishers should cache game-catalog information where reasonable rather than making unnecessary requests.

13. Publisher Earnings

Publisher earnings may be based on the commercial arrangement applicable to the publisher at the time eligible activity occurs.

Unless expressly identified as finalized, earnings displayed in reporting should be treated as estimated.

Estimated earnings may be adjusted for reasons including:

• Invalid activity
• Duplicate activity
• Fraud
• Reporting corrections
• Technical errors
• Policy violations
• Reversals
• Provider adjustments

Changes to future commercial rates do not necessarily change finalized historical amounts.

14. Revenue Sharing

GamesCrate may enter into revenue-sharing or other commercial arrangements with approved publishers.

Rates, eligibility, measurement and commercial terms may vary.

Nothing on the public website guarantees a particular income level.

Actual results depend on factors that can include:

• User activity
• Valid traffic
• Audience quality
• Geography
• Game availability
• Commercial terms
• Advertising conditions
• Platform policies

15. Earnings Finalization

GamesCrate may review eligible reporting before amounts become withdrawable.

Once a period is finalized, GamesCrate may create an accounting record and credit an eligible amount to a partner balance.

Finalized records may still be corrected where required by:

• Fraud
• Duplicate payment
• Legal requirements
• Material accounting error

We will not intentionally change finalized amounts merely because a future commercial rate changes.

16. Withdrawals

Approved partners may request withdrawals subject to:

• Available balance
• Minimum withdrawal requirements
• Approved payout methods
• Account status
• Verification
• Anti-fraud review

Submitting a withdrawal request does not mean the payment has already been sent.

Payments may be processed manually.

Publishers and developers are responsible for providing correct payment information.

GamesCrate is not responsible for loss caused by incorrect payout details supplied by the account holder.

17. Taxes

You are responsible for taxes, declarations, invoices and other obligations applicable to amounts you receive from GamesCrate unless the law requires GamesCrate to handle a particular tax or deduction.

GamesCrate may request documentation reasonably necessary for payment or compliance.

18. Games From Third Parties

Some games are supplied, hosted or operated by third-party developers and providers.

GamesCrate does not control every element inside third-party games.

A third-party game may:

• Become unavailable
• Change
• Contain advertising
• Use external services
• Have its own privacy practices
• Stop working on certain devices

We may remove or replace a game without notice when necessary.

19. Advertising

GamesCrate may display advertising before, around or within games and other content.

Advertisements may be supplied by GamesCrate, game providers or third-party advertising networks.

Advertisements do not necessarily represent endorsement by GamesCrate.

Advertisers are responsible for claims in their advertisements.

20. Acceptable Use

You must not use GamesCrate to:

• Break applicable law
• Upload malware
• Attempt unauthorized access
• Interfere with servers
• Exploit vulnerabilities
• Scrape protected areas
• Bypass access controls
• Manipulate earnings
• Generate fake plays
• Commit advertising fraud
• Impersonate another person
• Harass users
• Distribute unlawful material
• Infringe intellectual-property rights
• Use automated systems in a manner that harms GamesCrate

Security research must not damage the service or expose user information.

21. Intellectual Property

Except for third-party content and user/developer-owned material, GamesCrate's website design, software, branding, original text, interfaces and related materials are owned by or licensed to Cronweb Solutions Private Limited.

You may not copy, resell or reproduce GamesCrate proprietary material except where expressly authorized.

GamesCrate and related branding may not be used to falsely suggest endorsement or affiliation.

22. Copyright and Content Complaints

If you believe content on GamesCrate infringes your rights, contact us with enough information to identify:

• The protected work
• The allegedly infringing material
• The relevant URL
• Your contact information
• The basis of your claim

We may temporarily disable content while reviewing a legitimate complaint.

23. Availability

We aim to keep GamesCrate available, but we do not guarantee uninterrupted operation.

The service may be unavailable due to:

• Maintenance
• Hosting failures
• Network problems
• Game-provider failures
• Security incidents
• Third-party outages
• Software bugs
• Events outside our reasonable control

24. No Guarantee of Game Progress

Unless a game expressly supports saved progress, GamesCrate does not guarantee that gameplay progress will persist.

Some third-party games manage progress independently.

No-user Mode favorites and recently played history stored in local browser storage can be lost if browser storage is cleared.

25. No Warranty

To the maximum extent permitted by law, GamesCrate and its services are provided on an "as available" and "as is" basis.

We do not guarantee:

• Continuous availability
• Error-free operation
• Particular earnings
• Compatibility with every device
• Permanent availability of any game
• Accuracy of third-party content

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

26. Limitation of Liability

To the maximum extent permitted by applicable law, Cronweb Solutions Private Limited will not be liable for indirect, incidental, special or consequential losses arising from the use or inability to use GamesCrate.

This may include loss relating to:

• Third-party games
• External websites
• Lost browser data
• Business interruption
• Expected revenue
• Third-party advertising
• Unauthorized account access caused by your failure to protect credentials

Nothing in these Terms limits liability where such limitation is prohibited by law.

27. Indemnity for Business Users

Developers, publishers, advertisers and other business users agree, to the extent permitted by law, to be responsible for claims arising from:

• Content they submit
• Rights they claim to own
• Their website or application
• Fraudulent traffic they generate
• Their violation of these Terms
• Their violation of applicable law

28. Suspension and Termination

GamesCrate may restrict, suspend or terminate access where reasonably necessary for:

• Fraud
• Abuse
• Security
• Repeated policy violations
• Unlawful activity
• Payment manipulation
• Intellectual-property violations
• Protection of users or the platform

Suspension of a publisher stops new eligible publisher activity but does not automatically erase legitimate historical accounting records.

29. Changes to GamesCrate

We may add, modify or remove features at any time.

We may also update these Terms.

Material updates will be reflected by changing the date at the top of this page.

Continued use after an updated version becomes effective constitutes acceptance where permitted by law.

30. Governing Law

These Terms are governed by the laws applicable to Cronweb Solutions Private Limited in India, subject to any mandatory consumer rights that apply in your jurisdiction.

Where legally permitted, disputes will be subject to the jurisdiction of the competent courts associated with the registered office of Cronweb Solutions Private Limited in India.
